CodeFuel is a technology and media company that provides a range of services. We display advertisements, sponsored content or search results provided to us by our search feed partners or advertisers (“Services”). The Services may be offered by other companies including through apps, sites or products that display to you search results and ads by linking to our Services, or by our own developed extensions, software or apps that display the ads and search results through the Services (“CodeFuel Apps” or “Apps”).

This Privacy Policy is meant to help you understand what information we collect, why we collect it, and how you can control it.

Non-Personal Data

During your interaction with our Services we may collect aggregated, non-personal non-identifiable information which may be made available or gathered via your access to and use of the Services (“Non-Personal Data“). We are not aware of the identity of the user from which the Non-Personal Data is collected. We do not knowingly collect or process any Personal Data constituting or revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, biometric data, data concerning a person’s health or data concerning a person’s sex life or sexual orientation (“Special Categories of Personal Data”).

Recruitment: When you apply for a position via our website, we will process your CV (and the information included therein), as well as additional information such as your contact information (name, email address and phone number), information regarding your education and skills, employment history, and your photo (to the extent provided by you). Also, where allowed or required by law, we may process diversity and inclusion data regarding your candidacy, such as ethnicity, gender, or any disability. In addition, we may collect further information from public and online sources, referees, and former employers and combine such data with your other data.
Account Data: In the event you are or wish to become our partner, and offer our Services through your app, site, product, that display the ads and search results by linking to our Services etc. (“Publisher”), you can create an account through the website, or an account manager will designate you with an account which can be accessed through the website. The information provided during the registration process or login to your account will include your full name, email address, phone number, country, information about your company, your title and any other information you decide to provide us in connection with the registration. Additionally, you will be required to create a username and password. This information will be processed when you login as well. You represent and warrant that you will not provide us with inaccurate, misleading or false information.
PURPOSE AND OPERATIONS
We process such data through our or third party cookies and tracking technologies for analytic, marketing and advertising purposes. In addition, we process such data for operation, security and fraud prevention purposes.
We process such data to provide you with the support you requested or to respond to your inquiry. The correspondence with you may be processed and stored by us in order to improve our customer service.
We will use such data solely in order to provide you with the content that you have requested to receive. These messages contain content defined as "advertisement" or "direct marketing" under the Israeli law.
We will use such data to process your job application and for recruitment management purposes, for further recruitment steps (e.g., interview), and to enable us to comply with corporate governance and legal and regulatory requirements. We will use this data in order to create you an account, provide you with account management, support and to provide reports and information about the Services. We will use the email address you provided or the account to send you needed information related to our Services and which are related to our business engagement (e.g., send you a welcome message, notify you regarding any updates, send applicable invoices, reports etc.) and additional occasional communications and updates related to the Services, as well as promotional and marketing emails (“Direct Marketing”). We may also use the information in order to verify your identity.

Where we collect such data for analytic and advertising purposes, we process the data based on your consent which we will obtain through our cookie notice and consent management. In some cases, for example, where we will ask you to provide health related data or diversity and inclusion data, we will process your data based upon your consent. You may always withdraw consent at any time by contacting us. We will retain your data for records keeping and future defense from legal claims under our legitimate interest. Following the completion of the recruitment process, we may further retain and store the data (including other interactions with us under such process) as part of our internal record keeping, including for legal defense from any future claim, as well as, where we find applicable and subject to applicable law requirements, to contact you in the future for other job position we believe will suit your qualifications.
We process such data for the purpose of performing our contract with you, to provide the Services and to designate your account. Direct Marekting is based on our legitimate interest, you may opt-out at any time.

Interactions with our Apps

Unique Identifier and Usage Data: When you install and use the CodeFuel Apps we create an installation identifier that is identified with your device. We further collect Usage Data (as defined above).
Device Identifiers and Installer Apps: We collect information when your device contacts our servers. This information includes your device type and carrier name, crash reports, and apps or software you have installed.
We process the Usage Data subject to our contractual obligations with you, to enable the operation of the App. Other purposes, such as operational and security, are based on our legitimate interest.
Where we collect such data for operation and security, we process your data based on our legitimate interest. Otherwise, we will seek your consent.

IInteractions with the Service

Identifiers: We store the information that we collect with unique identifiers tied to the browser, application, or device you are using and being offered with the Services.
Views and interactions on SERP and with content and ads: We collect information about views and interactions with the search results or ads so we can provide aggregated reports to our Publishers offering the Service, we review if the ad was likely seen, for example the advertisement you have viewed or clicked on, your search queries, pages viewed, access time and date, directing URLs, etc. Note that such information is further shared with our otherwise Publishers, Search Partners, or directly collected by them.
Location: Based on the IP address or other information we may obtain such as zip code, we can approximately know your location.
Search Terms and browsing history. Note that such information is further shared with our Search Partners, or otherwise directly collected by them. We further share this information with our Search Partners, so that they can deliver the search result page (“SERP”) and with advertiser so they can deliver ads based on your interest.
Activity on third-party sites and apps that use our Services: When a Publisher offers our Services, we need to track and ensure they deliver and display the Services as we agreed. Therefore, each Publisher is designated with an identifier which is also associated with that Publishers’ users. Through this identifier we are able to process your activity on their apps, sites, products. This information includes the information listed above- the ads you view and click, the search terms and search history. Note that such information is further shared with our Search Partners, or otherwise directly collected by them.
This allows us to maintain your preferences across browsing sessions, your preferred language or whether to show you more relevant search results or ads based on your activity.
We use data for analytics and measurement to understand how our services are used, so that we can improve it. We also use data about the ads you interact with to help advertisers understand the performance of their ad campaigns and provide them with reports. We process such data to provide and operate the advertising related features of our Services.
We use this information for language preference and contextual advertisement- ads based on your general location. We further use this to understand where our partners are offering our Services.
We use your information to deliver our Services, such as processing the terms you search for in order to return results. We may also show you personalized ads based on your search terms. For example, if you search for “coffee” you may see an ad for coffee makers.
Same purposes and listed above, including the use of aggregated data to provide our partners that are offering and displaying our Services, reports and information on the ad campaigns.
We collect such data for the operation and security purposes and we will process such data based on our legitimate interest. Where the use is made for optimizing the content, search or ads, it is part of our efforts to improve to Service, and therefore based on contract.
We process this data based on our contract with you, so that we can improve our Services, and we use the aggregated data to provide Publisher’s with reports and information on the ad campaigns.

Therefore, the actual processing operation per each purpose of use and lawful basis detailed in the table above, may differ. Such processing operation usually includes set of operations, made by automated means, such as collection, storage, use, disclosure by transmission, erasure or destruction. Transfer of Personal Data to third party countries as further detailed in the International Data Transfer section is based on the same lawful basis as stipulated in the table above. 

In addition, we may use certain Personal Data to prevent potentially prohibited or illegal activities, fraud, misappropriation, infringements, identity thefts and any other misuse of the Services and to enforce our policies and agreements, as well as to protect the security or integrity of our databases and the Services, and to take precautions against legal liability. Such processing is based on our legitimate interests.

PURPOSE OF SHARING
We share the search terms so that the Search Partner can display the SERP.
We share this data through reports which includes analytic, performance of ad campaigns, ads viewed and clicked in an aggregated way, as well as for and security purpose (such as fraud detection).

In some cases when we buy media online, we may submit unique identifier. The unique identifier provided to the media owner, may become personally identifiable when such media owner combines our parameters with its own existed information about you, to which you gave your consent when first interacting with such media owner’s services (for example social media Services).
We may disclose Personal Data to our trusted agents and service providers (including, but not limited to, our Cloud service provider, our analytics service provider, our CRM provider, etc.) so that they can perform requested services on our behalf. DATA RETENTION: 

In general, we retain the Personal Data we collect for as long as it remains necessary for the purposes set forth above, all under the applicable regulation, or until you will express your preference to opt-out, where applicable. 

The retention periods are determined according to the following criteria:

  1. For as long as it remains necessary in order to achieve the purpose for which the Personal Data was initially processed. For example: if you contacted us, we will retain your contact information at least until we will address your inquiry.
  2. To comply with our regulatory obligations. For example: transactional data will be retained for up to seven years (or even more under certain circumstances) for compliance with our bookkeeping obligations purposes.
  3. To resolve a claim we might have or a dispute with you, including any legal proceeding between us, until such dispute will be resolved, and following, if we find it necessary, in accordance with applicable statutory limitation periods.

Other circumstances in which we will retain your Personal Data for longer periods of time include: (i) where we are required to do so in accordance with legal, regulatory, tax or accounting requirements, or (ii) for us to have an accurate record of your dealings with us in the event of any complaints or challenges, or (iii) if we reasonably believe there is a prospect of litigation relating to your Personal Data. SECURITY MEASURES: 

We work hard to protect Personal Data we process from unauthorized access or unauthorized alteration, disclosure or destruction. We have implemented physical, technical and administrative security measures for the Services that comply with applicable laws and industry such as: encryption using SSL, we minimize amount of data that we store on our servers, restrict access to Personal Data to CodeFuel employees, contractors and agents, etc. Note that, we cannot be held responsible for unauthorized or unintended access that is beyond our control, and we make no warranty, express, implied or otherwise, that we will always be able to prevent such access.

Please contact us at: privacy@perion.com if you feel that your privacy was not dealt with properly, in a way that was in breach of our Privacy Policy or if you become aware of a third party’s attempt to gain unauthorized access to any of your Personal Data. We will make a reasonable effort to notify you and the appropriate authorities (if required by applicable law) in the event that we discover a security incident related to your Personal Data. 

 

INTERNATIONAL DATA TRANSFER: 

Our data servers in which we host and store the information are located in the US. The Company’s HQ are based in Israel in which we may access the information stored on such servers or other systems such as the Company’s ERP, CRM and other systems. In the event that we need to transfer your Personal Data out of your jurisdiction, we will take appropriate measures to ensure that your Personal Data receives an adequate level of protection as required under applicable law. Furthermore, when Personal Data that is collected within the European Economic Area (“EEA“) is transferred outside of the EEA to a country that has not received an adequacy decision from the European Commission, we will take necessary steps in order to ensure that sufficient safeguards are provided during the transferring of such Personal Data, in accordance with the provision of the standard contractual clauses approved by the European Union. Thus, we will obtain contractual commitments and or assurances from the data importer to protect your Personal Data, using contractual protections that EEA and UK regulators have pre-approved to ensure your data is protected (known as standard contract clauses), or rely on adequacy decisions issued by the European Commission. INTERACTION WITH THIRD PARTY APP AND CONTENT:

Third Party App implementing our Services and any content or digital assets made available through your interaction with Third Party Content are provided directly by their owners or operators and governed by their own terms and privacy policies. Although we do require our Business Partners to ensure full compliance and transparency, we are not responsible for the privacy practices or the content of such Business Partners. 

 

ELIGIBILITY AND CHILDREN PRIVACY:

The Services are not intended for use by children (the phrase “child” shall mean an individual that is under the age defined by applicable law which with respect to the EEA is under the age of 16 and with respect to the US, under the age of 13) and we do not knowingly process children’s information. We will discard any information that we receive from a user that is considered a “child” immediately upon our discovery that such a user shared information with us.
